Products: Our trailers, control devices, accessories, and parts (the "Products");
c.
Communications & Social Media: Our electronic communications (including email and text/SMS), and your interactions with our official pages on social media platforms; and
d.
Related Services: Our customer support, preorder reservations, and offline interactions.
1.2
Your Consent. By accessing or using our Services—including browsing our Website, downloading our App, or driving/towing our Products—you acknowledge that you have read this Policy and consent to the data practices described herein. If you do not agree to this Policy, you must not access or use the Services.

Third-Party Services. This Policy does NOT apply to products, services, or websites controlled by third parties that you may interact with through Evotrex, even if linked or integrated for your convenience. Specifically:

Payment Processors: Financial transactions processed by third parties (e.g., Escrow, Stripe, Adyen) are subject to their own privacy policies.
b.
Financing Partners: Credit applications and leasing agreements are governed by the privacy policies of the respective financial institutions.

External Links: We are not responsible for the privacy practices of any third-party websites linked from our Services.

What Information We Collect
We collect personal information you provide directly, information automatically obtained when you use our Services, and personal information from third-party sources, as detailed below:
2.1
Personal Information You Provide Directly. We may collect the following personal information you submit:

Identifiers: Account name, nickname, full name, telephone number, postal address, Internet Protocol (IP) address, email address, signature, driver's license number, or other similar identifiers;
b.

Note regarding Social Security Numbers (SSN): While our interface may facilitate the input of your SSN for financing applications, Evotrex does not store or maintain your full SSN. Such data is transmitted directly to our financial partners through secure, encrypted channels.
f.
Communications content: Content of messages, survey responses, and feedback you send to us.
2.2
Order/Preorder Data and Transaction Data. When you place a preorder, reservation, or finalize a purchase for our Products, we collect information necessary to process the transaction, verify your identity for vehicle titling, and manage delivery. This includes:
a.
Transaction and Configuration Details: Your reservation ID, queue position, deposit amount, and the specific configuration of your Product (e.g., color, add-on accessories, and trim packages).
b.
Vehicle Documentation: Once a specific unit is assigned to you, we collect the Vehicle Identification Number (VIN), odometer reading, proof of insurance, and information required for title and registration (such as your driver's license number or government ID, where required by DMV regulations).
c.
Direct Payment and Financial Information: If you choose to pay Evotrex directly (e.g., via wire transfer, saving account, credit card or check), we collect your: Full legal name and billing address; Bank account information (including routing and account numbers); and Credit history and financial standing, where necessary to assess your ability to fulfill payment obligations.
d.
Third-Party Payment Processors: You may also elect to use third-party payment processors to handle deposits and payments. In these instances, Evotrex does not directly store your full credit card number or bank account credentials. We receive only transaction tokens, payment status, and partial payment information (e.g., the last four digits of your card) to verify the purchase.
e.
Financing and Credit Information: If you apply for financing or leasing through our Services, please be aware of the following: Direct Transmission: Any credit application data you submit (including your Social Security Number, income details, and credit history) is transmitted directly to our third-party financial partners (such as banks or leasing companies) for processing. No Storage of Credit Reports: Evotrex does not directly store your full credit report, credit score, or full Social Security Number. We are not a credit reporting agency and do not make credit decisions. We only receive a status update (e.g., "Approved," "Pending," or "Declined") and limited tokenized data necessary to finalize your order. Regulatory Compliance: Our financial partners are responsible for complying with applicable financial privacy laws, including the Fair Credit Reporting Act (FCRA) and the Gramm-Leach-Bliley Act (GLBA). Please review their privacy policies directly for information on how they handle your financial data.
2.3
Users Data (Post-Purchase). If you purchase our trailer or use our connected App, we collect data generated by the Product's sensors and internal systems ("Telematics") to verify warranty coverage, diagnose issues, and improve our energy management algorithms. This includes:
a.
Energy and Powertrain Data: Information regarding the high-voltage battery system (including State of Health [SOH], State of Charge, charging cycles, and temperature), range extender operation (fuel levels, engine hours, maintenance alerts), and energy usage habits (such as solar input vs. grid usage) used to optimize our range extension algorithms.
b.
Operational Dynamics: Data regarding the trailer's towing status, including mileage, tire pressure (TPMS), and hitch load distribution.
c.
Living Systems Usage: Status and usage metrics of onboard amenities, including water tank levels (fresh/gray/black), HVAC (Heating, Ventilation, and Air Conditioning) settings, internal temperatures, smart appliance usage, and slide-out or awning status.
d.
Connectivity and Remote Commands: Logs of your interactions with the Product via the Software for security and diagnostic purposes, such as remote locking/unlocking, climate control activation.
e.
Visual Sensor Data: Video feeds or images from external cameras (e.g., hitch alignment cameras or security/sentry cameras). Important Note: To comply with privacy laws (such as California's dual-consent recording laws), external cameras capture video only and do not record audio unless explicitly stated otherwise for a specific feature where you have provided express consent. Visual Sensor Data will be stored locally on the trailer ONLY, unless transmission or access is legally required by law enforcement authorities for security, detection, or investigative purposes.
2.4
Automatically Collected Information. We automatically collect the following information when you use our Services:
a.
Device information: IP address, MAC address, cookie identifiers, mobile carrier, mobile advertising IDs, browser type, operating system, Internet service provider, and router location information;
b.
Usage information: Content viewed, searches conducted, features used, access times, and navigation paths.
2.5
Information collected via technologies:
a.
Cookies: Small text files stored in your browser to store preferences and enhance user experience (including session cookies and persistent cookies). You may manage cookie preferences through your browser settings, but disabling certain cookies may affect the functionality of the Services.
b.
Pixel tags/web beacons: Code embedded in the Services to track engagement, such as webpage visits or advertisement clicks.
2.6
Personal Information from Third-Parties. We only collect personal information from third parties where permitted by law and ensure the source is legitimate:

Job Applicant Data
3.1

If you apply for a job with Evotrex through our "Careers" page or other channels, we collect the information you provide in your application, including your resume/CV, cover letter, employment history, education, and references. We may also collect background check information where permitted by law. This information is used solely for the purpose of evaluating your candidacy for employment and communicating with you regarding your application.

Retention of Applicant Data. If you are not hired, we will retain your application data for a limited period (as set forth in Section 8 Data Retention below) to consider you for future opportunities and to comply with reporting obligations or defend against potential legal claims.

We collect and process the data listed in Section 2 What Information We Collect (specifically Telematics and, subject to strict privacy controls, Visual Sensor Data) to innovate and enhance our Services. Algorithm Training and AI: To train and refine our machine learning models, particularly those governing towing stability, energy management, and autonomous hitching features;
b.
Fleet Health Analysis: To analyze aggregated trends in battery usage and hardware performance to identify potential defects or optimize range estimation; and

De-identification: To create anonymous, aggregated datasets that cannot be linked back to you, which we use for general business intelligence and industry analysis.
4.3
Safety, Security, and Compliance

Warranty & Diagnostics: To validate warranty claims, diagnose mechanical issues remotely, and maintain service records.

Safety Recalls: To contact you in the event of a safety recall or critical technical service bulletin.

Marketing and Communications

Note regarding Credit: As stated in Section 2 (under 'Financing and Credit Information'), Evotrex does not use automated decision-making to make creditworthiness decisions; such decisions are made exclusively by our third-party financing partners.

Other Purposes. With your consent or as explicitly permitted by law, we may use your personal information for other purposes disclosed to you at the time of collection.
5.
How We Disclose Personal Information
We disclose your personal information only in the following specific circumstances:

Roadside Assistance Providers: To dispatch help (e.g., towing, flat tire support) if you request assistance or if the vehicle detects a critical failure.
5.4
Advertising Partners. We may share identifiers (like cookies or advertising IDs) and usage data with third-party advertising companies to display interest-based ads. You have the right to opt out of this "sharing" as described in Section 7 (Your Rights and Choices).
5.5
Corporate Affiliates. We may share information with our subsidiaries and corporate affiliates within the Evotrex group to provide the Services and ensure consistent business operations.
5.6

5.7
Corporate Transactions. In the event of a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your personal information may be disclosed or transferred as part of the transaction.

Aggregated Data. We may share aggregated or de-identified data (which cannot reasonably be used to identify you) with third parties for legitimate business purposes, such as industry analysis or improving our AI algorithms.

Access Controls: We utilize multi-factor authentication (MFA) and strict role-based access controls (RBAC) to ensure only authorized employees can access personal data.

Vehicle Telematics and Usage Data: Retained for [7] years from the date of generation. This duration is necessary to support long-term vehicle diagnostics, validate warranty claims (which may extend for years), and comply with safety recall regulations (e.g., NHTSA requirements).

9.
International Transfers
9.1
U.S. Headquarters and Data Storage. Evotrex is based in the United States. Regardless of where you use our Services or purchase our Products, you acknowledge and agree that your personal information will be transferred to, processed, and stored primarily on servers located in the United States.
9.2
Transfers to the United States. If you are located outside the United States, please be aware that information we collect will be transferred to and processed in the United States. The data protection laws in the United States may differ from, and be less stringent than, those of your country or region (such as Canada and Australia). By using our Services, you explicitly consent to this transfer, processing, and storage in the United States.
9.3
Safeguards for Cross-Border Transfers. When we transfer personal data from a region with strict data protection laws to the United States, we ensure that your data is treated securely and in accordance with this Policy. Individuals under the age of 18 are not permitted to register for an account or use our Services.

11.2
Independent Policies: Once you leave our Services or are redirected to a third-party website, this Privacy Policy no longer governs. We strongly encourage you to review the privacy policy and terms of service of every site you visit.
11.3
Your Risk and Release: You acknowledge and agree that Evotrex shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. Your interaction with them is entirely at your own risk.
