Terms & Conditions

These SMS Terms & Conditions (“SMS Terms”) govern your participation in the Evotrex SMS Program, also referred to as “EVOTREX Text Alerts” (the “Program”), operated by Evotrex, Inc. (“Evotrex,” “we,” “us,” or “our”). These SMS Terms are part of, and incorporate by reference, our Terms of Service and Privacy Policy. If there is a conflict between these SMS Terms and the Terms of Service with respect to the Program, these SMS Terms control as to the Program.

The Program lets you receive text (SMS/MMS) messages relating to Evotrex’s products and services — including our website at www.evotrex.com, our software, and our hardware products (including trailers, control devices, accessories, and parts). Depending on the choices you make and how you interact with us, messages may relate to pre-orders, orders, delivery and account updates, events, promotions and marketing, customer service, and after-sales support.

You may enroll in the Program by submitting your mobile phone number and affirmatively agreeing to receive text messages — for example, by checking a dedicated, non-pre-checked SMS consent box on a Website form, pre-order page, or follow-up page, by texting a keyword to our number, or by another method we make available.

By opting in, you confirm that you are the subscriber to, or the customary user of, the mobile number provided, that you are at least the age of majority in your jurisdiction, and that you expressly consent to receive recurring automated marketing and informational text messages from Evotrex at that number, including messages sent using an automatic telephone dialing system or similar technology. Your consent to receive marketing text messages is not a condition of purchasing any goods or services.

Your consent applies only to the Evotrex SMS Program and is not transferable to any other program or sender. If you change or deactivate your mobile number, you agree to notify us and to opt out of the Program from the old number to avoid messages being sent to a reassigned number.

We maintain records of your opt-in, including the date, the form or channel used, the consent language presented, and related information, for compliance purposes.

Message frequency varies. You may receive recurring messages, and the number of messages you receive will depend on your interactions with us, your preferences, and the nature of the Program. We do not commit to a fixed number of messages.

Message and data rates may apply to each message sent or received in connection with the Program, depending on your mobile plan. Evotrex does not charge for the Program itself; any message or data charges are imposed by your mobile carrier and are your responsibility. Please contact your carrier for details about your messaging and data plan.

You may opt out of the Program at any time by replying STOP to any text message you receive from us. After you send STOP, we may send a single confirmation message acknowledging your opt-out, after which we will stop sending Program text messages to your mobile number unless you opt in again. You may also opt out by contacting us using the details in Section 9.

For help, reply HELP to any message or contact us using the details in Section 9. Opting out of the Program does not opt you out of other communications from Evotrex (such as transactional emails); to manage those, follow the instructions in the relevant message or our Privacy Policy. Standard keywords. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to cancel. Reply HELP for help. Message frequency varies. Message and data rates may apply.

Your privacy matters to us. Our collection and use of your personal information in connection with the Program is described in our Privacy Policy, including the section addressing SMS, mobile numbers, and opt-in data. 

No sharing of mobile opt-in data with third parties for their marketing. Evotrex will not sell, rent, or share your mobile opt-in information or SMS consent with any third parties or affiliates for their own marketing or promotional purposes. We may share your information with service providers that help us operate the Program — such as our SMS platform provider (such as Mailchimp), mobile carriers, and compliance and fraud-prevention vendors — solely to deliver and manage messages, process opt-outs, maintain compliance records, prevent fraud, and comply with law.

The data we collect and use to operate the Program may include your mobile phone number, opt-in status and consent records, message content and delivery data, and opt-out preferences.

The Program is available through major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless carrier and may be affected by factors outside our control. We do not guarantee that messages will be delivered, and we are not liable for any delays or failures in delivery.

The Program is intended for recipients with mobile numbers in the United States. We do not warrant that the Program is appropriate or available for use outside the United States.

We may modify or terminate the Program, or these SMS Terms, at any time, for any reason, with or without notice, to the extent permitted by law. If we make material changes to these SMS Terms, we will update the “Last Updated” date above and, where required, provide additional notice. Your continued participation in the Program after changes take effect constitutes your acceptance of the revised SMS Terms.

The Program is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Evotrex disclaims all warranties relating to the Program. Your use of the Program is also governed by the limitation of liability, dispute resolution, arbitration, and governing-law provisions of our Terms of Service, which are incorporated into these SMS Terms by reference.

You agree to comply with all applicable laws and these SMS Terms when participating in the Program. Evotrex operates the Program in a manner intended to comply with applicable U.S. law, including the Telephone Consumer Protection Act (TCPA) and applicable CTIA guidelines and carrier requirements.
