Introduction and Scope

This Cookie Policy (“Policy”) explains how Evotrex, Inc. (“Evotrex,” “we,” “us,” or “our”) uses cookies, pixels, tags, software development kits (“SDKs”), local storage, session-replay scripts, and other similar tracking technologies (collectively, “Cookies and Similar Technologies”) on our website located at www.evotrex.com and any associated subdomains, ordering pages, pre-order pages, referral pages, and online forms (collectively, the “Website”).

This Policy describes the main types of Cookies and Similar Technologies we use, the principal categories of providers and tools currently deployed or planned for deployment on the Website, the general purposes for which they are used, the types of information they may collect, and the choices and controls available to you. Specific cookie names, identifiers, durations, and technical behaviors may vary depending on your browser, device, region, consent choices, Shopify settings, and third-party provider updates. Where available, more detailed and current information may be provided through our Cookie Preferences tool or Cookie Declaration.

Geographic scope. The Website and our products are directed to users in the United States, Canada (excluding the Province of Quebec), and Australia. 

This Policy supplements, and should be read together with, our Privacy Policy and our Terms of Service. Capitalized terms not defined in this Policy have the same meaning in our Privacy Policy.

Our Website is hosted on the Shopify platform. Some Cookies and Similar Technologies described in this Policy are set by Shopify to operate the Website, and others are set by us or by third-party vendors that we engage for analytics, advertising, and content functionality.

What Are Cookies and Similar Technologies?

Cookies are small text files that are placed on your computer, tablet, or mobile device when you visit a website. They are widely used to make websites work, to make them work more efficiently, and to provide information to the website operator and to third parties.

  • First-party cookies are set by the website you are visiting (here, Evotrex).
  • Third-party cookies are set by a domain other than the one you are visiting, typically by service providers we engage (for example, Google or Meta).
  • Session cookies are temporary and are deleted when you close your browser.
  • Persistent cookies remain on your device until they expire or you delete them.

Similar technologies that we may use, alone or in combination with cookies, include:

  • Pixels / web beacons / tags: tiny, often invisible images or snippets of code embedded in web pages or emails that record that a page or message was viewed and that may transmit information (such as your IP address, device identifiers, and browsing activity) to the technology provider.
  • Software development kits (SDKs): blocks of code provided by third parties and integrated into our Website or applications that collect information about your device and use of our services.
  • Local storage and similar device storage (including HTML5 local storage and “flash” objects): used to store information and preferences on your device.
  • Session-replay and heatmap scripts: technologies that record, in aggregated and/or pseudonymized form, how users interact with pages (for example, mouse movements, clicks, scrolling, and form interactions, excluding masked sensitive inputs).

For convenience, this Policy refers to all of these as “Cookies and Similar Technologies” .

How We Use Cookies and Similar Technologies

We use Cookies and Similar Technologies to:

  1. Operate the Website and enable core functions such as page navigation, security, load-balancing, shopping-cart and checkout functionality, and fraud prevention;
  2. Remember your settings and preferences (for example, language, region, and consent choices);
  3. Measure and analyze how visitors find and use the Website so that we can improve its performance and content;
  4. Understand the effectiveness of our marketing and advertising, measure conversions, and (where you have consented or have not opted out) deliver and measure targeted advertising on third-party platforms; and
  5. Provide interactive content features such as shoppable and informational video.

We do not use Cookies and Similar Technologies to collect biometric identifiers (such as facial-recognition or voiceprint data) through the Website, and we do not knowingly deploy non-essential tracking technologies before obtaining consent where consent is legally required (see Section 6).

We classify the Cookies and Similar Technologies on our Website into the following categories. You can manage each category (other than Strictly Necessary technologies) through our Cookie Preferences tool (see Section 7).

Message and data rates may apply to each message sent or received in connection with the Program, depending on your mobile plan. Evotrex does not charge for the Program itself; any message or data charges are imposed by your mobile carrier and are your responsibility. Please contact your carrier for details about your messaging and data plan.

Strictly Necessary. Essential for the Website to function and cannot be switched off in our systems. They are usually set only in response to actions you take, such as setting your privacy preferences, logging in, adding items to a cart, or completing a pre-order, and they do not require consent under most legal frameworks.

Functional / Preferences. Enable enhanced functionality and personalization, such as remembering your region, language, or choices you have made. If you do not allow these, some services may not function properly.

Analytics / Performance. Help us understand how visitors interact with the Website by collecting and reporting information, generally on a pseudonymized or aggregated basis.

Advertising / Targeting. Set by us and by our advertising partners to build a profile of your interests, measure campaign performance, cap ad frequency, and show you relevant advertising on other websites and platforms. They may involve “sharing” personal information for cross-context behavioral advertising and, under certain laws, may be treated as a “sale” of personal information.

Social Media / Content Interaction. Set by third-party content and social platforms whose features (such as video players or share buttons) are embedded in our Website. They may track your activity across websites.

Note on data collected. The analytics and advertising tools below may collect your IP address, device and browser identifiers, general location inferred from IP address, referring URLs, pages and content viewed, search terms entered on the Website, clicks, and other usage data, which the provider may combine with information it holds from other sources. Tools in the Analytics, Advertising, and Social Media / Content categories are non-essential and are deployed only in accordance with the consent and opt-out mechanisms in Sections 6 and 7.

Specific Cookies and Similar Technologies on Our Website

The table below identifies the principal third-party providers and tools that we currently use or may use on the Website, together with their general categories and purposes. This table is intended to provide a practical summary of our main Cookies and Similar Technologies, rather than an exhaustive technical inventory of every cookie, pixel, tag, local-storage object, SDK event, or identifier that may be set or read.

Cookie names, identifiers, durations, domains, and technical behaviors are determined in part by Shopify, our third-party providers, your browser or device settings, and our configuration choices, and may change from time to time. Where available, more detailed or updated information about specific cookies and similar technologies may be provided through our Cookie Preferences tool, provider notices, or browser controls.

We encourage you to review our Cookie Preferences tool for the most current information available about the Cookies and Similar Technologies used on the Website.

Our Consent and Opt-Out Approach

Different laws require different treatment of Cookies and Similar Technologies. We apply the following approach across our target markets.

Strictly Necessary technologies are always active because they are required for the Website to function. They are not subject to consent.

Non-essential technologies (Functional, Analytics, Advertising, and Social Media / Content categories) are handled as follows, depending on where you are located:

  • United States: We present a cookie banner and provide notice of our use of Cookies and Similar Technologies. You can opt out of (i) the “sale” and “sharing” of personal information and (ii) targeted/cross-context behavioral advertising, and limit certain uses, as described in Section 9.1. We honor recognized opt-out preference signals, including the Global Privacy Control (“GPC”), where required by applicable state law. For users in states where applicable law requires opt-out or other restrictions, we provide the required notices and opt-out controls and configure applicable technologies to respect those choices.
  • Canada (excluding Quebec): Consistent with the Personal Information Protection and Electronic Documents Act (“PIPEDA”), we rely on your consent (express or implied, as appropriate to the sensitivity of the data) for non-essential technologies and provide a clear opportunity to decline. You may withdraw your consent at any time through the Cookie Preferences tool, subject to legal and contractual limits.
  • Australia: Consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”), we notify you of our collection through Cookies and Similar Technologies and provide controls to manage non-essential technologies through the Cookie Preferences tool.

Where we cannot reliably determine your location, we present cookie choices and, for analytics and advertising technologies, apply the more protective treatment among our target markets (including withholding non-essential technologies until you make a choice).

We maintain records of consent and opt-out choices (including, as applicable, the time, the page, the consent text version, and the choice made) for compliance and accountability purposes.

7.
How to Manage Your Cookie Preferences

You have several ways to control Cookies and Similar Technologies:

  1. Evotrex Cookie Preferences tool. You can review and change your choices at any time by selecting “Cookie Preferences” (or “Your Privacy Choices”) available in the Website footer and through the link below. The tool lets you accept or reject non-essential categories and withdraw previously given consent.
  2. Global Privacy Control (GPC) and other opt-out signals. We recognize the GPC signal where required by applicable law. If you visit the Website with a GPC-enabled browser or extension, we will treat that signal as a request to opt out of the sale/sharing of personal information and of targeted advertising for the browser and device from which the signal is sent. Because GPC is browser- and device-specific, you may need to enable it on each browser and device you use.
  3. Browser controls. Most browsers let you refuse or delete cookies and clear local storage through their settings. Because the steps differ by browser, please consult your browser’s help resources (for example, for Chrome, Safari, Firefox, or Edge). Blocking all cookies may affect the functioning of the Website.

Opt-out choices stored in cookies will be lost if you delete cookies or use a different browser or device.

“Do Not Sell or Share My Personal Information” / “Your Privacy Choices”

Our use of certain advertising and analytics technologies — including Google Ads and the Meta Pixel — may constitute a “sale” or “sharing” of personal information for cross-context behavioral advertising under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA/CPRA”), and may constitute “targeted advertising” or a “sale” under other U.S. state privacy laws. We treat GPC as an opt-out request for the browser or device from which the signal is sent.

You can exercise your right to opt out of such sale/sharing and of targeted advertising by:

  • selecting “Do Not Sell or Share My Personal Information” or “Your Privacy Choices” in the Website footer;
  • adjusting the Advertising/Targeting category in our Cookie Preferences tool; and/or
  • enabling the Global Privacy Control (GPC) in your browser, which we will honor as an opt-out request where required by law.

We will not discriminate against you for exercising any of your privacy rights.

9.
Region-Specific Information and Your Rights
9.1

United States (California, Illinois, and Other States)

The United States does not have a single comprehensive federal privacy law, but a number of U.S. states have enacted comprehensive privacy laws. Depending on your state of residence and whether the applicable legal thresholds are met, you may have rights under the state privacy law of your residence.

  1. California (CCPA/CPRA). California residents have the right to know what personal information we collect and how we use and disclose it; to access, delete, and correct personal information; to opt out of the sale or sharing of personal information; and to limit the use of sensitive personal information. As described in Section 8, you may opt out of sale/sharing and targeted advertising through our “Do Not Sell or Share My Personal Information” / “Your Privacy Choices” controls and via GPC. We will not discriminate against you for exercising these rights.
  2. Other state privacy laws. Residents of other states with comprehensive privacy laws generally have rights to access, correct, and delete personal data, to obtain a portable copy, and to opt out of (i) targeted advertising, (ii) the sale of personal data, and (iii) certain profiling. Many of these laws require us to honor universal opt-out mechanisms such as GPC. You can exercise these rights through the mechanisms in Sections 7 and 8 or as described in our Privacy Policy.
  3. Illinois. Based on our current Website configuration, the Website does not use Cookies or Similar Technologies to collect biometric identifiers or biometric information (such as facial geometry, fingerprints, or voiceprints) within the meaning of the Illinois Biometric Information Privacy Act (“BIPA”). Session-replay and heatmap technologies are configured to mask sensitive inputs and are not used to capture biometric identifiers.

Notice regarding tracking technologies. We provide detailed, tool-by-tool disclosure (Section 5) and obtain consent or provide opt-out choices for non-essential technologies (Sections 6–8) so that any collection of your IP address, device information, search terms, and browsing activity by the technologies described above occurs only with appropriate notice and choice.

9.2

Canada (excluding Quebec)

If you are in Canada (other than Quebec), our handling of personal information collected through Cookies and Similar Technologies is subject to the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and any applicable substantially similar provincial laws.

  1. Consent. We rely on your consent (express or implied, depending on the sensitivity of the information and the context) for non-essential technologies, and we provide a clear opportunity to accept or decline through our cookie banner and Cookie Preferences tool.
  2. Your rights. You may request access to the personal information we hold about you, request correction of inaccurate or incomplete information, and withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawing consent may affect certain features.
  3. Cross-border transfer. Information collected through these technologies may be transferred to and processed in the United States by us and our providers. We use contractual and other safeguards intended to provide a comparable level of protection, and your information may be accessible to U.S. authorities under applicable law.
  4. Privacy Officer / complaints. You may contact our Privacy Officer at privacy@evotrex.com  (Subject: “Attn: Privacy Officer”). If you are not satisfied with our response, you may lodge a complaint with the Office of the Privacy Commissioner of Canada.
  5. Quebec. The Website is not directed to residents of Quebec, and we do not currently offer a Quebec-specific French-language experience or Quebec-specific privacy disclosures. If our activities change, we will reassess applicable Quebec requirements.
9.3

Australia

If you are in Australia, our handling of personal information collected through Cookies and Similar Technologies is subject to the Privacy Act 1988 (Cth) and the Australian Privacy Principles (“APPs”).

  1. Notice and management. We notify you of our use of Cookies and Similar Technologies and provide controls to manage non-essential technologies through the Cookie Preferences tool.
  2. Access and correction. You may request access to, and correction of, the personal information we hold about you. We will respond within a reasonable period and, if we refuse, provide written reasons and information about how to complain.
  3. Overseas disclosure. By using the Website, you acknowledge that information collected through these technologies may be disclosed to and stored in the United States. While we take reasonable steps to ensure overseas recipients handle personal information consistently with the APPs, we may not be accountable for an overseas recipient’s acts in all circumstances.
  4. Complaints. You may contact us at privacy@evotrex.com. If you are dissatisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
10.
Children

The Website is not directed to children, and we do not knowingly use Cookies and Similar Technologies to collect personal information from children below the age of consent in the applicable jurisdiction. If you believe a child has provided personal information through the Website, please contact us using the details in Section 13.

11.
Data Retention

Cookies and Similar Technologies may persist for different periods, typically ranging from the end of a browsing session to up to approximately two years, depending on the specific technology, provider, browser or device settings, and our configuration. Where available, more detailed or current information about specific durations may be provided through our Cookie Preferences tool, Cookie Declaration, provider notices, or browser controls.

Personal information collected through these technologies is retained in accordance with the retention periods and criteria set out in our Privacy Policy, and is deleted or de-identified when no longer needed for the purposes for which it was collected or as required by law. You can delete cookies stored on your device at any time through your browser settings.

Changes to This Cookie Policy

We may update this Policy from time to time to reflect changes in the technologies we use, in applicable law, or in our business practices — including the addition, removal, or replacement of analytics and advertising tools. When we make material changes, we will revise the “Last Updated” date above and, where required by law, provide additional notice or seek renewed consent.
